MP, magistrate summoned in case where Cecil Miller is acting for late Galgalo’s widow

An MP and a magistrate were yester-day summoned to appear before the High Court and testitv in a dispute over administration of former Moyale MP Guracha Galgalo’s estate. High Court judge Lady Justice Joyce Aluoch also ordered the Moyale Member of parliament, Mr Wario Malta Galgalo, a brother of the dead MP, to appear in Court on March 13 when the case will be heard, Also required in court is a magistrate stationed in Limuru, Mr Abdul Raman Aminga and Nairobi Kadhi Almuhdhar Ahmed Hussein. The judge made the order following an application by lawyer Alfred Nyandieka representing Dr Guracha’s widow, Ms Bernadette. Mr Nyandieka told the court that the three had sworn affidavits and he wanted to question them.

Ms Shama is involved in a legal dispute with Ms Rehema Dida Jaldesa who is claiming tribe Dr Guracha’s wife.. Ms Jaldesa wants the court to revoke temporary powers given to Me Shama to administer the estate. Ms Jaldesa has been listed as a beneficiary of the property in documents filed in court by Ms Shama. She was indicated as a mistress of the dead MP, but she contends that she is his wife.

And judge questioned why Ms Jaldsea was being referred to as a mistress. Mr Nyandieka told the court that Ms Jaldesa was described as such because she is married to another man. The judge heard that Ms Jaldasa’s previous marriage had not been dis-solved. But Ms Jaldesas lawyer, Mr Cecil Miller, said the marriage was conducted according to the Islamic law and had been dissolved.
