Ex-Chase Bank boss fails to raise Sh60m bond

Khan is set to spend his fifth night in remand after he failed to raise the Shoo million bond. On Thursday, a magistrate’s court ordered Mr Khan to present two sure-ties in order to secure his freedom, an amount his lawyers argued was too high. Tomorrow, Mr Khan’s lawyer Cecil Miller is expected to ask the court for the review of the bond downwards. “The bond terms are too high for my client. He has been unable to fulfil them. He also has a medical problem which is getting worse by the day” said Mr Miller.

Mr Khan (below) is remanded at Industrial Area prison. He faces Shl.7 billion fraud charges. Senior Principal Magistrate Mar-tha Mutuku issued the bond terms on Thursday, while indicating that she will give a detailed ruling to-morrow. The magistrate allowed Mr Khan to make travel arrangements to the US to seek medical treatment within 30 days. She, however, directed that Mr Khan deposits his passport in court after the expiry of those days.

The prosecution, through State lawyer Warui Mungai, had told the court on Wednesday that the accused is a flight risk. The court further issued summons against his seven co-accused who were not present when he was charged. They are expected to present themselves to the police so as to be arraigned in court to plead to their charges . They are Mr Duncan Kabui, James Mwaura, Makarios Omondi, Abdul Ahmed, Harish Shah, Ms Amira Clau-dia and Mr Mohamed Nasrullah.
