A leading city lawyer has sued another for making defamatory remarks against him during the hearing of an election petition.
Cecil Miller is seeking general damages for libel and slander, and aggravated and exemplary damages from Peter Gichuki.
Miller defended the March 4, 2013 election of Othaya MP Mary Wambui while the Gichuki sought to nullify her win. Miller has accused Gichuki of making malicious, false and defamatory statements against him.
He says Gichuki accused him of colluding with the presiding judge of the Court of Appeal,Justice Kihara Kariuki, to have the file placed before him.
Miller says he was shocked when the defendants claimed he conspired with Deputy Registrar Moses Serem to purportedly change the case’s hearing dates.“ The defamatory statements insinuated that I am of questionable integrity as I abused my authority as an office of the court to intimidate the judiciary,” he says.
